Understanding DUI & BAC

There are extremely tough laws on the
books for DUI and DWI. Refusing to
submit to a breath, blood, or urine test
is a serious matter. When you received
your drivers license you agreed to the
Implied Consent Law. This says that you
consent to take a chemical test if a
police officer believes that you are
driving under the influence. If your BAC
is higher than 0.08 percent in Virginia,
you will be charged with a "per se"
violation. This will happen even if you
are not actually impaired by alcohol,
your charge will stem from BAC level
alone.The higher the BAC, 0.15 percent
or higher, the longer mandatory jail
time you will face. A first DUI offense
is a Class 1 misdemeanor. Your third
offense is a felony.
Following is a chart to understanding
Blood Alcohol in Males and Females. This
guide is based off the Virginia DMV's
best guess as to what breath test
results would be obtained for a given
amount of drinking. One drink is
equivalent to 1 ounce of 80 proof
spirits, a 3 ounce glass of wine, or an
8 ounce glass of 5% beer.
